Terms of Service

These Terms govern your use of justesims.com (the "Site") and the eSIM data plans sold through it (together, the "Service"). The Service is operated by JusteSIMs (ABN 28 764 919 720), of 3 Churchill Dr, Moonbi NSW 2353, Australia ("JusteSIMs", "we", "us"). By using the Service, you agree to these Terms together with our Privacy Policy, Cookie Policy, Refund Policy, Acceptable Use Policy, Delivery Policy and Coverage & Service Disclaimer, each incorporated by reference. If you do not agree, do not use the Service.
1. Who we are and what we sell
JusteSIMs is an Australian-registered reseller of prepaid travel eSIM data plans. We do not own or operate any mobile network — connectivity is provided by third-party mobile network operators and aggregators ("Network Partners"). Contact us at support@justesims.com.
2. Eligibility
You must be at least 18 (or the age of majority where you live), have legal capacity to contract, not be located in or ordinarily resident in a country subject to comprehensive sanctions administered by Australia, the UN, EU, UK, or the US Office of Foreign Assets Control, and own or lawfully possess an unlocked, eSIM-compatible device. We may refuse or cancel orders that do not meet these criteria.
3. The plans
Each plan lists its countries of coverage, data allowance, validity period, and any fair-use limit on the product page. Those details are part of these Terms once you order. Coverage, speed, and quality depend on the Network Partner and your device — none are guaranteed. See the Coverage & Service Disclaimer.
You are responsible for confirming that your device is eSIM-compatible and carrier-unlocked before you buy. A compatibility guide is on the Site.
4. Orders, prices, and payment
Prices display in the currency you select and include GST or VAT where required by law. Your bank may add foreign-exchange or international-transaction fees.
When you place an order you make an offer to buy; the contract forms when we send the activation email. We may cancel and refund any order where we suspect fraud, an eligibility issue, or a pricing error. Payment authorises us (or our payment provider) to charge your selected method. Your bank statement will show "JUSTESIMS" or similar.
5. Delivery
eSIMs are delivered digitally by email, usually within minutes of payment. See the Delivery Policy.
6. Activation and expiry
The validity period begins the moment your device first connects to the Network Partner using the eSIM ("activation"), or on the activation deadline shown on the product page, whichever is earlier. Once activated it runs continuously and cannot be paused. Unused data and unused validity time are forfeited at the end of the period. eSIMs are for the original purchaser's personal use and may not be resold or commercially redistributed without our written consent.
7. Fair use and acceptable use
Your use of the Service is subject to the Acceptable Use Policy. In short: no unlawful use, no spam, malware or fraud, no sanctions breaches, no reselling, and no exceeding of the plan's fair-use limit. Fair-use daily allowances vary by plan (typically 500 MB – 10 GB per day at full speed); once reached, speeds are reduced to a 2G-equivalent (approx. 128 – 512 Kbps) for the remainder of the day. The specific limit for a plan is shown on its product page. We may throttle, suspend, or terminate access for actual or suspected breaches.
8. Refunds
Refunds are governed by the Refund Policy. In short: full refund if the eSIM is not activated (within 30 days of purchase); non-refundable once activated, except for a service fault on our side or a Network Partner's, or where mandatory consumer law requires otherwise.
9. Intellectual property
The Site, the JusteSIMs brand, logos, and all related content are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial use. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works except as permitted by law.
10. Third parties
The Service depends on Network Partners, payment processors, and hosting and email providers. We are not responsible for their acts, omissions, terms, or policies.
11. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, or that any particular coverage, speed, or quality will be available. Nothing in this section limits any consumer guarantee that cannot lawfully be excluded.
12. Your consumer rights
Australia. If you are a consumer within the meaning of the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth) ("ACL")), nothing in these Terms excludes, restricts, or modifies any right, guarantee, or remedy you have under the ACL. EU / UK. If you are a consumer resident in the EEA or UK, you have a 14-day right to withdraw from a distance contract for digital content. By installing or activating the eSIM within that period you expressly request immediate performance and lose the right to withdraw on activation. Where the right still applies, contact support@justesims.com within 14 days of purchase.
Elsewhere. Any mandatory consumer-protection right under the law of your country of residence applies in addition to these Terms and prevails to the extent of any inconsistency.
13. Limitation of liability
To the maximum extent permitted by law:
- Neither party is liable for indirect, incidental, special, or consequential loss, including loss of profits, revenue, data, business, or goodwill.
- Our total aggregate liability arising out of or in connection with the Service or these Terms is limited to the greater of (a) the total amount you paid us for the Service in the 12 months before the event giving rise to the claim, and (b) AUD $100.
- Where Australian law implies a guarantee that cannot lawfully be excluded, our liability for breach is limited (at our option) to re-supplying the Service or paying the cost of having it re-supplied.
- Nothing in this section limits liability that cannot be limited by law (including for fraud, wilful misconduct, or personal injury caused by negligence).
14. Indemnity
You indemnify us against any third-party claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your breach of any law, or your infringement of any third-party right.
15. Suspension and termination
We may suspend or terminate your access at any time if we reasonably believe you have breached these Terms or applicable law, or if continued service would expose us or a Network Partner to legal, regulatory, or operational risk. On termination, unused balances on activated plans are forfeited, subject to the Refund Policy and applicable consumer law.
16. Changes
We may update these Terms from time to time. The current version is posted at justesims.com/terms with an updated effective date. Material changes will be notified to registered users by email or in-product notice. Continued use after a change takes effect constitutes acceptance.
17. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia. Before commencing any legal action, contact support@justesims.com and allow us 30 days to attempt a good-faith resolution. Subject to any mandatory consumer-protection law of your country of residence, you submit to the exclusive jurisdiction of the courts of New South Wales.
18. General
Entire agreement. These Terms, with the policies incorporated by reference, are the entire agreement about the Service. Severability. Unenforceable provisions are severed; the rest continue in force. No waiver. A delay in enforcing any right does not waive it. Assignment. You may not assign without our written consent; we may assign to an affiliate or in a corporate transaction. Force majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control.
